Terms of Service

Article 1 (Purpose)

These Terms of Service are established to define the rights, obligations, responsibilities, and other necessary matters between the Company and Members in relation to the use of the AI-based image processing service (hereinafter referred to as "Service") provided by PhotoRush (hereinafter referred to as "Company").

Article 2 (Definitions)

1. "Service" refers to the AI-based image processing and related additional services provided by the Company.
2. "Member" refers to a person who has agreed to these Terms and has entered into a service usage agreement with the Company.
3. "Credits" refers to the virtual payment method purchased by Members to use the Service.
4. "Content" refers to images and other data that Members upload or create through the Service.

Article 3 (Effect and Amendment of Terms)

1. These Terms shall take effect by posting them on the Service screen or by notifying Members through other methods.
2. The Company may amend these Terms as necessary within the scope that does not violate relevant laws and regulations, and the amended Terms shall be notified in the same manner as in Paragraph 1.
3. If a Member does not agree to the amended Terms, they may discontinue use of the Service and withdraw from membership.

Article 4 (Membership Registration and Contract Formation)

1. Membership registration is established when a user agrees to these Terms and completes the registration application according to the procedures set by the Company.
2. The Company may refuse membership registration or terminate the usage agreement afterwards in the following cases:
   • When using another person's identity
   • When providing false information
   • When applying in violation of relevant laws and regulations
   • When failing to meet other usage requirements set by the Company

Article 5 (Provision and Modification of Services)

1. The Company provides the following AI-based image processing services:
   • Watermark Removal: AI-powered removal of watermarks from images
   • Background Removal: Automated removal of image backgrounds with transparent PNG output
   • Image processing history management and download functionality
   • Credit-based payment system and credit management
   • Other image processing services that the Company develops additionally or provides through partnership agreements
2. The Company may change the content of the Service and shall notify such changes in advance.
3. Processing costs in credits may vary by service type and are clearly displayed on each service page.

Article 6 (Credits and Payment)

1. Credits must be charged to use the Service.
2. Credit charging is conducted through payment methods provided by the Company and is reflected immediately upon payment completion.
3. Charged Credits can be used by the Member directly for the Service and cannot be transferred to others or refunded in cash.
4. However, refunds are possible in the following cases:
   • When normal use is impossible due to Service failure
   • When the Service cannot be provided due to the Company's fault
   • Other cases stipulated by relevant laws and regulations

Article 7 (Member Obligations)

1. Members shall not engage in the following activities:
   • Uploading content that infringes on others' copyrights, portrait rights, or other rights
   • Processing illegal or obscene content
   • Actions that interfere with the normal operation of the Service
   • Collecting, storing, or disclosing others' personal information without authorization
   • Commercial activities using the Company's Service
   • Other actions that violate relevant laws and regulations
2. Members are responsible for securely managing their account information and cannot transfer or lend their account to third parties.

Article 8 (Company Obligations)

1. The Company shall make its best efforts to provide stable Service and shall promptly restore the Service in case of failure.
2. The Company shall establish and comply with a Privacy Policy to protect Members' personal information.
3. The Company shall respect Members' opinions and endeavor to reflect reasonable opinions.

Article 9 (Copyright and Content Management)

1. The copyright of content uploaded by Members belongs to the Members, and the Company shall use such content only for the purpose of providing the Service.
2. The Company may delete processed images after a certain period has elapsed following delivery to the Member.
3. Members shall bear legal responsibility for the content they upload and shall be responsible for not infringing on third parties' rights.

Article 10 (Restriction and Suspension of Service Use)

1. The Company may restrict or suspend Service use in the following cases:
   • When a Member violates these Terms
   • When system inspection, maintenance, or replacement is necessary
   • When force majeure events such as natural disasters or national emergencies occur
2. The Company shall notify in advance when restricting or suspending Service use for the reasons in Paragraph 1. However, in urgent cases, notification may be provided afterwards.

Article 11 (Disclaimer)

1. The Company shall be exempt from liability when it cannot provide the Service due to force majeure such as natural disasters, war, or suspension of telecommunications carrier services.
2. The Company shall not be liable for Service usage disruptions caused by the Member's fault.
3. The Company does not guarantee the reliability or accuracy of information or materials obtained by Members through the Service and shall not be liable for damages arising therefrom.
4. The Company has no obligation to intervene in disputes that occur between Members or between Members and third parties and shall not be liable for damages arising therefrom.

Article 12 (Dispute Resolution)

1. Disputes arising between the Company and Members in relation to these Terms shall be resolved through mutual consultation.
2. If consultation under Paragraph 1 is not reached, the court having jurisdiction over the location of the Company's headquarters shall be the exclusive jurisdiction court in accordance with relevant laws and regulations.

Supplementary Provisions

These Terms shall take effect from November 21, 2025.
